Mill St., Rubey Park Transit Facility addition Date: ~Apri.42441991_, APPLICANT'S REQUEST: HPC's Final Development approval for the addition to the Rubey Park Transit Facility LOCATION: 419 S. Mill St., Lots K, L, M, N, 0. P, Q, R, and S, Block 90, City and Townsite of Aspen APPLICANT: Roaring Fork Transit Agency, Dan Blankenship, Director, represented by Gibson and Reno, Architects ZONING: Public, "H", Historic Overlay District PROJECT SUMMARY: The proposal is for a 9' expansion of approximately 435 sq. ft. of the transportation terminal northward, which is necessary to increase internal office space for personnel use. The materials will match the existing structure exactly, including color of brick. The applicant has requested that the north elevation windows be slightlv elonqated over the conceptually approved plans. Staff finds this request to be compatible with the structure and district. GMQS exemption by Council is still required prior to the issuance of a building permit. PREVIOUS HPC ACTION: Conceptual development approval was granted (no conditions) by the HPC on March 13, 1991. STAFF COMMENTS: The Development Review standards are found in Section 7-601(D). Staff finds that the standards have been met in this proposal, which has been designed to match materials and massing of the existing structure. We recommend that RFTA incorporate additional bike racks and/or bike storage facilities in this expansion, and that the design of these features be submitted for staff approval prior to installation. L -DESCRIPTION OF PROPOSED DEVELOPMENT- The proposed development is located at 419 South Mill Street which consists of Lots K,L,M,N,0,P,Q,R and S in Block 90. It will be an addition to Rubey Park Transit Facility. Expansion of the north side of the terminal will add approximately 9'-0" to the existing building. Within this expansion there will be a stair added to access a new loft area which will expand into the attic space over the existing offices. All of the expanded area will only be used by RFTA personnel for offices and locker space. The total additional square footage is approximately 435 S.F. -FINAL DEVELOPMENT PLAN- There were no conditions placed on this development at the Conceptual Review. The Client has requested that we consider making the windows taller on the north elevation. This is to be looked at and should be finalized prior to the final HPC Review. In consideration of the mutual promises herein contained, the parties agree as follows: I. GRANT OF LEASE; DESCRIPTION OF PREMISES The City, as Lessor, hereby grants to RETA, as Lessee, che non-exclusive right to use the City-owned "Rubey Park", described in Exhibit "A" annexed hereto, for the purpose of operating transit related activities such as an information center, bus stop, and bus staging for the lease term. I. 8. 555 42988 2 and consist of the bus shelter, bricks, and grass walkways. No additional improvements shall be constructed by RETA without prior written consent of City. IV. CONSIDERATION As consideration for this agreement the parties agree to provide the following: 1. RETA at its own expense shall perform or provide the following services under the direct supervision of the Director of Leisure Services: a) Maintain and repair the Bus Shelter. b) Provide trash removal, in addition to the City's parks barrel trash containers, sufficient to handle debris generated by transit activities. c) Provide snow removal in areas other than sidewalks and parking lot. d) Pay all utility associated with the Rubey Park Bus Shelter. .- 2. The City shall perform or provide the following services as consideration for the lease payment: a) Provide trash removal from the parks barrels. b) Provide snow removal from parking lot and sidewalks adjacent to Rubey Park. c) Maintain landscaping within Rubey Park. V. LIMITATION TO DESCRIBED PURPOSES 0000 555 e.(989 3 RFTA shall use Rubey Park solely for the purpose of operating transit related activities such as an information center, bus stop, and bus staging. VI. INDEMNIFICATION AND LIABILITY INSURANCE RETA shall defend, indemnify, and hold the City harmless from any and all claims, suits, costs and liability occasioned by the acts or neglects of RETA, or its agents, employees, or invitees. In this regard, RFTA shall procure, at RFTA's own expense, public liability coverage for the benefit of RETA and City (naming the City as co-insured) with limits of not less than those specified by Section 24-10-114, C.R.S., as it may be amended from time to time. RETA shall maintain such coverage in full force and effect during the term of this agreement and shall furnish City with a copy of such insurance policy or a certificate evidencing such coverage prior to, and as a condition of, the use of the property in accordance with the terms of this agreement. All insurance policies maintained pursuant to this paragraph shall contain an endorsement substantially as follows: :' It is he·reby understood and agreed that this insurance policy may not be cancelled by the surety nor the intention not to renew be stated by surety until thirty (30) days after receipt by the City, by registered mail, of a written notice of such intention to cancel or not to renew". VII. TERMINATION AND AUTOMATIC RENEWAL B. 555 RAE 990 4 (a) This agreement may be terminated upon sixty (60) days written notice of termination; provided, however, that if notice of termination is given by City after October 1 of any year, this agreement shall terminate on the next succeeding April 15 or sixty days from the date of written notice, whichever period is longer. (b) In the event of breach of any material provision, this agreement may be terminated upon ten (10) days' written notice. VIII. NO ASSIGNMENT RFTA shall not assign this lease or any rights granted pursuant to this agreement without the prior written consent of City. IX. It will be an addition to Rubey Park Transit Facility. Expansion of the north side of the terminal will add approximately 9'-0" to the existing building. Within this expansion there will be a stair added to access a new loft area which will expand into the attic space over the existing offices. All of the expanded area will only be used by RFTA personnel for offices and locker space. The total additional square footage is approximately 435 S.F. .. -REVIEW STANDARDS- a. The proposed development is compatible in character with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in an H, Historic Overlay District or is adjacent to an Historic Landmark. For Historic Landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot or exceed the allowed floor area. HPC shall find that such variation is more compatible in character with the historic landmark, than would be development in accord with dimensional requirements. This development is an addition to the existing building at Rubey Park. The Rubey Park Transit Facility is the only building on this parcel of land, and it has been determined that it is compatible with adjacent buildings and the surrounding Historic Overlay District. Because the addition has a design similar to the original building, it should itself be compatible. b. The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. The proposed addition reflects the materials and design of the existing building. This consists of a brick facade and gables with a metal roof. These elements are also seen in the buildings in the neighborhood. The Independence Square Hotel has red brick. Guides restaurant has gables with a metal roof. Plus, the building that houses the Paradise Nightclub has brick and gable roofs. The character and charm of the neighborhood is maintained. C. The proposed development enhances or does not detract from the cultural value of designated historic structures located on the parcel proposed for development or adjacent parcels. There will be little or no impact on the cultural value of area as the building addition continues to compliment the area with its use of materials. d. The proposed development enhances or does not diminish or detract from the architectural integrity of a designated historic structure or part thereof. In consideration of the mutual promises herein contained, the parties agree as follows: I. GRANT OF LEASE; DESCRIPTION OF PREMISES The City, as Lessor, hereby grants to RFTA, as Lessee, che non-exclusive right to use the City-owned "Rubey Park", described in Exhibit "A" annexed hereto, for the purpose of operating transit related activities such as an information center, bus stop, and bus staging for the lease term. IL LEASE TERM The lease granted hereby shall be for a period of one (1) year, commencing on the date this agreement is duly executed by the City. Thereafter, said lease be automatically renewed anh shall continue in full force and effect for successive one-year periods unless otherwise terminated in accordance with the provisions of this agreement. III. CONSTRUCTION OF IMPROVEMENTS The parties acknowledge and agree that the existing improvements on the Rubey parcel are as depicted on Exhibit "A", BOOK 555 42988 2 and consist of the bus shelter, bricks, and grass walkways. NO additional improvements shall be constructed by RFTA without prior written consent of City. IV. CONSIDERATION As consideration for this agreement the parties agree to provide the following: l. RFTA at its own expense shall perform or provide the following services under the direct supervision of the Director of Leisure Services: a) Maintain and repair the Bus Shelter. b) Provide trash removal, in addition to the City's parks barrel trash containers, sufficient to handle debris generated by transit activities. c) Provide snow removal in areas other than sidewalks and parking lot. d) Pay all utility associated with the Rubey Park Bus Shelter. - 2. The City shall perform or provide the following services as consideration for the lease payment: a) Provide trash removal from the parks barrels. b) Provide snow removal from parking lot and sidewalks adjacent to Rubey Park. c) Maintain landscaping within Rubey Park. V. LIMITATION TO DESCRIBED PURPOSES .. a. 555 .989 3 RFTA shall use Rubey Park solely for the purpose of operating transit related activities such as an information center, bus stop, and bus staging. VI. INDEMNIFICATION AND LIABILITY INSURANCE RFTA shall defend, indemnify, and hold the City harmless from any and all claims, suits, costs and liability occasioned by the acts or neglects of RFTA, or its agents, employees, or invitees. In this regard, RFTA shall procure, at RFTA's own expense, public liability coverage for the benefit of RETA and City (naming the City as co-insured) with limits of not less than those specified by Section 24-10-114, C.R.S., as it mav be amended from time to time. RFTA shall maintain such coverage in full force and effect during the term of this agreement and shall furnish City with a copy of such insurance policy or a certificate evidencing such coverage prior to, and as a condition of, the use of the property in accordance with the terms of this agreement. All insurance policies maintained pursuant to this paragraph shall contain an endorsement substantially as follows: :1 Ic is ht: reby understood and agreed that this insurance policy may not be cancelled by the surety nor the intention not to renew be stated by surety until thirty (30) days after receipt by the City, by registered mail, of a written notice of such intention to cancel or not to renew". (b) In the event of breach of any material provision, this agreement may be terminated upon ten (10) days' written notice. VIII. NO ASSIGNMENT RETA shall not assign this lease or any rights granted pursuant to this agreement without the prior written consent of City. IX. L -DESCRIPTION OF PROPOSED DEVELOPMENT- The proposed development is located at 419 South Mill Street which consists of Lots K,L,M,N,0,P,Q,R and S in Block 90. It will be an addition to Rubey Park Transit Facility. Expansion of the north side of the terminal will add approximately 9'-0" to the existing building. Within this expansion there will be a stair added to access a new loft area which will expand into the attic space over the existing offices. All of the expanded area will only be used by RFTA personnel for offices and locker space. The total additional square footage is approximately 435 S.F. .. -REVIEW STANDARDS- a. The proposed development is compatible in character with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in an H, Historic Overlay District or is adjacent to an Historic Landmark. For Historic Landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot or exceed the allowed floor area. HPC shall find that such variation is more compatible in character with the historic landmark, than would be development in accord with dimensional requirements. This development is an addition to the existing building at Rubey Park. The Rubey Park Transit Facility is the only building on this parcel of land, and it has been determined that it is compatible with adjacent buildings and the surrounding Historic Overlay District. Because the addition has a design similar to the original building, it should itself be compatible. b. The proposed development reflects and is consistent with the character of the neighborhood Of the parcel proposed for development. The proposed addition reflects the materials and design of the existing building. This consists of a brick facade and gables with a metal roof. These elements are also seen in the buildings in the neighborhood. The Independence Square Hotel has red brick. Guidos restaurant has gables with a metal roof. Plus, the building that houses the Paradise Nightclub has brick and gable roofs. The character and charm of the neighborhood is maintained. c. In consideration of the mutual promises herein contained, the parties agree as follows: I. GRANT OF LEASE; DESCRIPTION OF PREMISES The City, as Lessor, hereby grants to RE'TA, as Lessee, the non-exclusive right to use the City-owned "Rubey Park", described in Exhibit "A" annexed hereto, for the purpose of operating transit related activities such as an information center, bus stop, and bus staging for the lease term. RFTA at its own expense shall perform or provide the following services under the direct supervision of the Director of Leisure Services: a) Maintain and repair the Bus Shelter. b) Provide trash removal, in addition to the City's parks barrel trash containers, sufficient to handle debris generated by transit activities. c) Provide snow removal in areas other than sidewalks and parking lot. d) Pay all utility associated with the Rubey Park Bus Shelter. 2. The City shall perform or provide the following services as consideration for the lease payment: a) Provide trash removal from the parks barrels. b) Provide snow removal from parking lot and sidewalks adjacent to Rubey Park. c) Maintain landscaping within Rubey Park. V. LIMITATION TO DESCRIBED PURPOSES .. 0000 555 mg989 3 RFTA shall use Rubey Park solely for the purpose of operating transit related activities such as an information center, bus stop, and bus staging. VI. INDEMNIFICATION AND LIABILITY INSURANCE RFTA shall defend, indemnify, and hold the City harmless from any and all claims, suits, costs and liability occasioned by the acts or neglects of RETA, or its agents, employees, or invitees. In this regard, RFTA shall procure, at RFTA's own expense, public liability coverage for the benefit of RETA and City (naming the City as co-insured) with limits of not less than those specified by Section 24-10-114, C.R.S., as it may be amended from time to time. RETA shall maintain such coverage in full force and effect during the term of this agreement and shall furnish City with a copy of such insurance policy or a certificate evidencing such coverage prior to, and as a conditicn of, the use of the property in accordance with the terms of this agreement. All insurance policies maintained pursuant to this paragraph shall contain an endorsement substantially as follows: ;'It is hereby understood and agreed that this insurance policy may not be cancelled by the surety nor the intention not to renew be stated by surety until thirty (30) days after receipt by the City, by registered mail, of a written notice of such intention to cancel or not to renew". VII. TERMINATION AND AUTOMATIC RENEWAL 0 . B. 555 PAGEggo 4 (a) This agreement may be terminated upon sixty (60) days written notice of termination; provided, however, that if notice of termination is given by City after October 1 of any year, this agreement shall terminate on the next succeeding April 15 or sixty days from the date of written notice, whichever period is longer. (b) In the event of breach of any material provision, this agreement may be terminated upon ten (10) days' written notice. VIII. NO ASSIGNMENT RETA shall not assign this lease or any rights granted pursuant to this agreement without the prior written consent of City. IX.
