A RESOLUTION OF THE HISTORIC PRESERVATION COMMISSION APPROVING A MINOR DEVELOPMENT FOR A CARPORT, PORCH, AND MASTER BEDROOM ADDITION TO THE RESIDENCE ON A PARCEL LOCATED AT 435 MAIN STREET, CITY OF ASPEN, COLORADO. Parcel ID # 2735-124-50-053 Resolution No. _39_, Series of 2000 WHEREAS the applicant, ALH Building Corp, represented by Gibson Architects, has requested minor development approval for a carport, porch, and master bedroom addition for the residence on a parcel located at 435 Main Street; and, WHEREAS, all development in an "H," Historic Overlay District or development involving a property listed on the "Inventory of Historic Sites and Structures" must meet all four Development Review Standards of Section 26.415.010.B.4 of the Aspen Land Use Code in order for HPC to grant approval, namely: 1. Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H," Historic Overlay District or is adj acent to an Historic Landmark. For Historic Landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot or exceed the allowed floor area by up to five hundred (500) square feet or the allowed site coverage by up to five (5) percent, HPC may grant such variances after making a finding that such variation is more compatible in character with the historic landmark and the neighborhood, than would be development in accord with dimensional requirements. In no event shall variations pursuant to this section exceed those variations allowed under the Cottage Infill Program for detached accessory dwelling units pursuant to Section 26.40.090(B)(2). 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. 3. Standard: The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or on adjacent parcels. 4. The applicant shall be required to provide the contractor with copies of the HPC resolution applicable to this project. The contractor must submit a letter addressed to HPC staff as part of the building permit application indicating that all conditions of approval are known and understood and must meet with the Historic Preservation Officer prior to applying for the building permit. 3. All representations made by the applicant in the application and during public meetings with the Historic Preservation commission shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions. Gilbert Sanchez was excused. Staff in attendance was Historic Preservation Officer, Amy Guthrie and Chief Deputy City Clerk, Kathleen Strickland. 232 E. HALLAM - EXTENSION OF APPROVAL DATE Nick Lelack, planner relayed to the board that a variance was approved for a six- foot fence in the front facade o f the house at the July 26,2000 meeting. The berm variance was denied. In the conditions of approval the berm was to be removed within 14 days and a trail easement was to be given to the city within 30 days. The applicant has asked for additional time in order to do all the landscaping in the front and on the public-right-o f-way o f their house at the same time. Regarding the trail easement they are having complications with their neighbors regarding their property lines. The applicant requests that the dates are changed to October 15,2000 and staff ; is in agreement. Rally expressed his concern regarding the project and the numerous changes requested. Staff also agreed with Rally. Nick stated that the applicant is going to do more work in the pubic right-of-way than initially planned. Nick informed the board that the applicant has filed a formal appeal against the denial o f the berm variance because they could not meet the dates. With the date changes they will withdraw their appeal. MOTION: Melanie moved to approve the revised resolution #37, 2000 approving the fence and denying the berm residential design standard variancefor a single-family residence at 232 E. MAIN - L'AUBERGE -MINOR DEVELOPMENT Mick Lelack, planner informed the board that this is an application for a minor development to the non-historic residence, managers unit. The proposal is to add a carport, porch and an expanded master bedroom to the property. Staff feels it is compatible to the site and neighborhood. David Gibson, architect was sworn in. The entire block is low scale and they are trying to continue that with small additions to the managers units. The proposal is to add 120 feet to the master bedroom, carport and porch. On the south end the bedroom will go out about ten feet. MOTION: Rally recommended approval for the minor development for L'Auberge property located at 435 W. Main Street, L'Auberge, On-site relocation- Public Hearing DATE: May 9, 2001 SUMMARY: There are nine original (c. 1940's) cabins on this property and nine new ones, added in 1995. The application is to relocate one of the new cabins 10 feet closer to Main Street, and to construct two new parking spaces. APPLICANT: ALH Gunnison, Inc., represented by Dave Gibson. PARCEL ID: 2735-124-50-053. ADDRESS: 435 W. Main Street, Lots A-I, Block 38, City and Townsite ofAspen. ZONING: Office. ON-SITE RELOCATION No approval for on-site relocation shall be granted unless the Historic Preservation Commission finds all of the following standards are met: A. The relocation activity is demonstrated to be the best preservation method for the character and integrity of the structure and the historic integrity of the existing neighborhood and adjacent structures will not be diminished due to the relocation. Staff Finding: The cabin that is to be moved is not historic. Its relocation has no direct impact on any ofthe original buildings. A parking spot will be displaced by the cabin relocation. The applicant intends to create a new space right behind the structure, off the alley. Another new parking spot is planned behind the "manager's residence." Staff has no concerns with this proposal. The HPC should be aware that an adjoining property owner has informed the Planning Department of a private agreement between himself and the applicants. This type of 1 EAdot k 74 .. agreement is not enforced by the City and the HPC's only role is to determine if the standards established in our Land Use Code are met. Any other issues must be resolved between the neighbors. B. The structure has been demonstrated to be capable of withstanding the physical impacts of the relocation and re-siting. A structural report shall be submitted by a licensed engineer demonstrating the soundness of the structure proposed for relocation. Staff Finding: This condition is not necessary because the building is new. C. A relocation plan shall be submitted, including posting a bond or other financial security approved by HPC with the engineering department, to insure the safe relocation, preservation, and repair (if required) of the structure, site preparation and infrastructure connections. The receiving site shall be prepared in advance of the physical relocation. Staff Finding: The relocation plan and letter of credit shall be conditions of approval. Staff recommends a fairly small value for the bond, $5,000, only to ensure any damage to the building or site be properly corrected. RECOMMENDATION: Staff recommends that HPC approve On-site relocation for the cabin at 435 W. Bleeker Street, finding that the review standards and design guidelines are met, with the following conditions: 1. The applicant must post a bond or letter of credit in the amount of $5,000 to ensure that any damage to the cabin or site caused by the relocation is corrected. 2. The on-site parking space displaced by the move will be reconstructed directly off the alley, in the space vacated by the cabin. The feasibility of the project has been discussed with Bailey Housemovers, and it is believed that the relocation can be readily accomplished and done without damage to the cabin. At the same time, an additional parking place, accessing off the alley, which was previously approved during the 1995 reviews and approval of the project, but never constructed, is proposed to be constructed at the SW corner of the property. This agreement was finalized, signed by all parties and presented to the Aspen City Council on April 18, 1995 and was subsequently recorded in the County Clerks Office on April 24, 1995 in Book 779, Page 236 et. al. Section 2.a. of the signed agreement specifically prohibits "development or parking" in the area south of the "Manager's Residence" (which residence is now used for rental or other purposes). Section 2.b. specifically prohibits "development or parking" in the area south of Cabin 21 (now renamed Cabin 20) Section 2.c. specifically states that any lilac bushes that die from any cause, shall be replaced by the owners. In late June or early July of 1999, two of the original large, mature lilac bushes were removed and a gravel parking pad was installed in the prohibited area. I wrote to the owners on July 14, 1999 (copy attached). When they were reminded of the agreement, they promptly removed the gravel, resodded the "reserved open space", put up a fence and planted three smalllilac bushes (see photos). Section 5 specifically states that we are "entitled to injunctive and other equitable relief to enforce the provisions ofthis agreement". In addition to your not approving the current request, we ask you to instruct the owners to replace the small lilac bushes with some larger bushes, more comparable to those removed in 1999 and to remind them of Section 2.b. prohibiting all parking south of Cabin 21 (now Cabin 20), Section 2.d. prohibiting short term guests from having dogs on the property and Section 5. specifring liquidating damages of $100 per violation. Furthennore, neither the Goldenberg's, Renee Marcus or Mrs. Scott's attorney received the legal notice that was supposedly sent out earlier this month. We understand that you forgot about the agreement but now would appreciate it ifyou would replace the new gravel with grass and replace the lilac bushes. Also most ofthe guests in cabin 21 park behind the cabin where parking is also prohibited. You are evidently not aware ofthe noise, dog and automobile problems caused by some of your guests especially from the cabins nearest to us. They occasionally park in the alley or even on our grass and gun their auto engines outside our bedroom window at 6 A.M. You should be able to get an on street "C" parking permit for any of your permanent vehicles and a few "guest" street parking permits for temporary use. That's what we do. We have been in touch with Tracy about the guests who bring their dogs and then walk them on our property. She has assured us that dogs are not allowed and we believe that she is doing her best to make sure that short term guests do not bring them. It's unfortunate that people do not clean up after their dogs but our experience is that they don't. We know that the agreement was made a while ago but the terms are still in effect and we understand that some ofthese details may have slipped your mind because you don't live on the property but this is our home and these matters are important to us. ALH desires to expand the L'Auberge facility through the addition of a number of new lodging units, as generally depicted on the site plan attached hereto as Exhibit C (the "Site Plan") and incorporated herein by this reference. D. Goldenberg, as the owner of the Goldenberg Property which is adjacent to the L'Auberge Property, is willing to consent to the proposed expansion of L'Auberge by ALH and refrain from objecting to such expansion during the land use approval process, provided that ALH grant the protective covenants and other rights and restrictions as described herein. Prior to the issuance of a building permit to construct any new cabin(s), ALH will deposit $10,000.00 (the "Escrow Funds") with an escrow agent ( "Escrow Agent") selected by mutual agreement of the parties. Escrow Agent shall disburee the Escrow Funds to ALH provided that the alley paving is completed (as defined hereinafter) prior to the issuance of a certificate of occupancy for any of the new improvements to the Property as depicted on the Site Plan. The paving shall be undertaken in accordance with the minimum specifications (the "Specifications") set forth on Exhibit A attached hereto and incorporated herein by this reference. Notwithstanding the foregoing, if the Specifications are inconsistent with design, engineering or material specifications of the City of Aspen at the time the paving is to be done, the City's specifications shall be followed. Goldenberg shall have the right to challenge the implementation of the City'e specifications in the event they believe the City's specifications will result in an inability to pave the alley. b. After paving the alley, ALH shall provide Goldenberg and the Escrow Agent with a Certificate of Completion from an architect or engineer approved by Goldenberg. Goldenberg hereby approves of the architectural firm of Gibson Reno for this purpose. " (1) ALH shall be responsible for the repair of any damage to the existing or future paved portions of the alley which damage is caused by any construction activity on the Property related to construction of improvements contemplated by the Site Plan. Any monies required to satisfy this obligation shall be funded by ALH from sources other than the Escrow Funds. In order to verify whether or not any such damage has resulted from construction activity, ALH shall, at ite expense, have an inspection of the alley undertaken by a licensed civil engineer after a building permit for the construction of improvements on the Property has been issued but prior to the commencement of any such construction. After a certificate of occupancy has been issued for the work covered by the permit a similar inspection (the "C.O. Inspection") shall be again conducted to determine if any damage has occurred to the pavement of the alley. It shall be a rebuttable presumption that any such damage was the result of such construction. The foregoing procedure shall be followed for all construction on the Property, whether it proceeds in one phase or several phases. All remedial work shall be conducted by ALH within 210 days of the date of the C.O. Inspection. C. In the event that Goldenberg objects, in a writing delivered to the Escrow Agent and ALH, to the Certificate of Completion or the completed status of the alley paving or the satisfactory remediation of damages to the alley, or if ALH objects to the determination of its responsibility for damages to the alley, the parties shall submit these questions to a licensed civil engineer mutually selected by the parties. If the parties cannot agree on the engineer then the attorneys for the parties shall each select an engineer and those engineers shall select a third engineer whose decision shall be binding on this issue. The alley paving shall not be deemed completed until written notice approving of such completion shall have been delivered to Escrow Agent by Goldenberg or by the selected engineer. d. In the event that the alley paving is not completed within 210 days of the issuance of a certificate of occupancy for any of the new improvements to the Property as depicted on the Site Plan, Goldenberg may elect to undertake to have the alley paved, and the expenses incurred thereby as submitted to Escrow Agent by Goldenberg shall be paid by Escrow Agent out of the Escrow Funds, to the extent such Escrow Funds are available. Any costs of alley paving incurred in excess of the amount of Escrow Funds shall be paid by Goldenberg. These protective covenants shall run with the land comprising the Property and shall be an appurtenance of and a benefit to the Goldenberg Property, and shall remain a burden on the Property until terminated. This Agreement shall only be enforceable and effective at such time that the development of the property as described in the Site Plan or any development generally consistent therewith has been approved by the City of Aspen and a final plat for such development has been filed. Unless sooner terminated in accordance with any other provieions of this Agreement, this Agreement ehall terminate at such time that neither Goldenberg nor Renee Marcus (a current owner of a unit in the 430 W. Hopkins Condominiums) own any Units in the 430 W. Hopkins Condominiums. In the event Goldenberg fails to execute and record a notice of termination of thie Agreement within thirty (30) days after neither Goldenberg nor Renee Marcus own any Units in the 430 W. Hopkins Condominiums, an affidavit of an officer of a title insurance company located in Aspen, Colorado which affirms that, based upon its review of the public records, neither Goldenberg nor Renee Marcus own any Units in the 430 W. Hopkins Condominiums, shall be sufficient, when recorded in the real property recorde of Pitkin County, Colorado,to terminate this Agreement. 5. Enforcement. It is the intent of the parties hereto that, iii addition to the causes of termination of this Agreement set forth in paragraph 4 above, this Agreement shall be terminated in the event that ALH is unsuccessful, after two independent and diligent GMQS applications, in obtaining approval for its proposed expansion of L'Auberge for additional lodging or residential units or any modified propoeal therefore, which ie generally consistent with the Site Plan. After the second such proposal ia denied by the City of Aspen and after all applicable periods of appeal have expired without a succeasful challenge to such denials by ALH, Goldenberg shall, within a reasonable time following request therefor from ALH, execute and deliver to ALH a written termination of this Agreement. In the event ALH obtains an approval for a development generally consistent with the Site Plan but such approval expires due to ALH's failure tobuild the project (the "Expired Approval "), the terms of this Agreement shall apply to any subsequent development of the Property generally consistent with the Site Planas if the Expired Approval had not occurred. 7. Miscellaneous. a. The parties hereto hereby agree that each of them will take whatever actions are reasonably necessary or desirable from time to time to effectuate the provisions or intent of this Agreement, and to that end, the parties hereto hereby agree to execute, acknowledge, and deliver any further instruments or documents which may be necessary to give force and effect to this Agreement or any of the provisions hereof, or to carry out the intent of this Agreement or any of the provisions hereof. b. This Agreement may be executed in any number of counterparts, each of which shall be effective upon delivery and thereafter shall be deemed an original, and all of which shall be taken to be one and the same instrument, for the same affect as if all parties hereto had signed the same signature page Any signature page of this Agreement may be detached from any counterpart of this Agreement without impairing the legal effect of any signatures thereon and may be attached to another counterpart of this Agreement identical in form hereto but having attached to it one or more additional signature pages. This Agreement may be executed in facsimile counterparts and each party agrees to promptly deliver to the other part.y an original of the executed counterpart. Any notice sent by telecopier or similar facsimile device shall also be mailed. Notices delivered personally shall be deemed given upon actual receipt; mailed notices shall be deemed given as of three (3) days after mailing. f. If any term, provision, covenant or condition of this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated. g. In the event of any litigation or arbitration arising in whole or in part out of this Agreement, the prevailing party in such litigation or arbitration shall be entitled to reasonable attorney fees, court costs, arbitration costs, and necessary disbursements in addition to any other relief to which such party may be entitled. h. This Agreement shall be binding upon and inure to the benefit of the parties hereto, and their respective distributees, executors, administrators, successors, assigns, heirs and personal representatives, and all persons who acquire an interest in the Property or any part thereof.
