WHEREAS, Donald and Karen Ringsby, as owners of the real property described as 514' North Third Street (metes and bounds legal description attached), City and Townsite Of Aspen, Colorado; and Sandra Lore, as owner of the real property described as 1004 East Durant Street, #1, East 8' of Lot L, and the West 22' of Lot M, Block 47, East Aspen Townsite, have filed an application for historic landmark designation pursuant to Section 7-701 of the Land Use Code, and WHEREAS, the property at 514 N. 3rd St. was listed in the 1980 Inventory of Historic Sites and Structures, as amended in 1986, and has received the historic evaluation rating of "4"; and the property located at 1004 E. Durant St., Unit #1, was listed in the Inventory of Historic Sites and Structures on April 11, 1989, and has received the historic evaluation rating of "4", and WHEREAS, the Historic Preservation Committee recommended historic designation for both structures at a duly noticed public hearing on May 10, 1989, and WHEREAS, the Aspen Planning and Zoning Commission recommended historic designation at a duly noticed public hearing on June 6, 1989; and . HISTORIC EVALUATION RATING: "4" SUMMARY: This property will become Aspen's 94th designated historic landmark. PROCEDURE FOR REVIEW: Landmark designation is a three-step process, requiring recommendations from both HPC and P&Z (public hearing at P&Z level), then first and second reading (public hearing at Final reading) of the designation ordinance by Council. The designation grant is expected to be approved by Council at Final reading as well. An application for HPC minor development review is expected to be submitted to the Planning Office within the next few weeks, which involves the rehabilitation of attic space into two bedrooms, requiring UBC flexibility by the Building Department for historic landmarks. HISTORIC LANDMARK DESIGNATION STANDARDS: The Standards for Landmark Designation are found in Section 7-702(A) of the Land Use Code. .Any structure or site that meets one (1) or more of the standards may be designated as a Historic Landmark. Staff finds that the application meets the criteria in both Standards E. (Neighborhood Character) and F. (Community Character). Standard E. Neighborhood Character: The structure or site is a significant component of an historically significant neighborhood and the preservation of the structure or site is important for the maintenance of that neighborhood character. Response: Clearly, the "Hallam Lake District" has long been 0 0 considered as one of Aspen's most significant historic neighborhoods. This structure is located within the context of this neighborhood. Its preservation is a critical element in the continued integrity of the historic West End character. Standard F. Community Character: The structure or site is critical to the preservation of the character of the Aspen community because of its relationship in terms of size, location and architectural similarity to other structures or sites of historical or architectural importance. Response: The Inventory file in the Planning Office states: "The significance of this residential structure is not of those who owned it or lived in it, nor of its architecture, although this structure is representative of Aspen's early mining era. This modest structure is of historical importance by illustrating the family/home environment and life styles of the average citizen in Aspen which was dominated by the silver mining industry." Photos indicate that from 1980 to today, the structure has been altered by an enclosed front porch and additional wing added. The original integrity of the simple 12/12 pitch cross gabled roof, projecting front gable bay, chimneys, clapboard and gable peak shingles exists. This structure embodies the small scale miner's cottage style that is indicative in Aspen and speaks to our heritage. Durant St., Second Reading, Ordinance #32 Date: July 10, 1989 SUMMARY: The Planning Office recommends approval of Ordinance #32, Series of 1989 on Second Reading, which combines two Landmark Designations in one ordinance. Both applicants have applied for a $2,000 Designation Grant, which they are eligible for through Ordinance 42, Series of 1987. LOCATIONS: 514 N. 3rd St., Aspen 1004 E. You can determine whether your application requires notice, and the type of notice it requires, from Table 1, which is attached to this summary. Following is a summary of the notice requirements, including identifying who is responsible for completing the notice. 1. Publication Publication of notice in a paper of general circulation in the City of Aspen is to be done at least 15 days prior· .to the hearing. The legal notice will be written by the Planning Office Administrative Assistant and we will place the notice in the paper within the appropriate deadline. 2. Posting Posting of a sign in a conspicuous place on the property is to be done 10 days prior to the hearing. It is the applicant's responsibility to obtain a copy of the sign from the Planning Office, to fill it in correctly and to bring proof (preferably a photograph) to the hearing· that posting took place. 3. Mailing Mailing of notice is to be made to all owners of property within 300 feet of the subject development parcel by the applicant. It is the applicant's responsibility to obtain a copy of the notice from the Planning Office, to mail it according to the following standards, and to bring proof to the hearing (in the form of a signed affidavit) that the mailing took place. Standards for notice shall be as follows: a. Any federal agency, state, county or municipal government service district or quasi governmental agency that owns property within 300 feet of the subject property must be mailed notice 15 days prior to the hearing. b. All other landowners within 300 feet of the subject property must be mailed notice 10 days prior to the hearing, unless notice is given by hand delivery, in which case it must be sent 5 days prior to the hearing. C. Subdivision applications only also require notice by registered mail to all surface owners, mineral owners and lessees of mineral owners of the subject property. Attachment 6 General Summary of Three Step HPC/Commission/Council Application Process 1. Application Types: The following are the Development Applications which are processed in three steps by the HPC, Commission and Council: * Designate Historic Structure 2. Development Review Procedure Summary. The three step HPC/ Commission/Council review procedure can be described as follows. Stage One: Attend pre-application conference. The purpose of this one-on-one meeting with staff is to determine the review process into which your development proposal fits and to identify the materials staff will need to review your application. Stage Two: Submit Development Application. Based on your meeting with staff, you should respond to the appropriate portions of the application package and submit the requested number of copies of a complete application, with the appropriate processing fee, to the Planning Office. Stage Three: Determination of Completeness. Within five working days of the date of your submission, the application package will be reviewed by a member of the staff. You will be notified in writing of whether the application is complete or if additional materials are required. Please be aware that the purpose of the completeness review is to determine whether or not yOU have submitted what was requested, not whether the information is sufficient to obtain approval. Stage Four: Review of Development Application. Once your application is determined to be complete, a date for its review by the HPC will be set. The submission due date is 25 days prior to the HPC review date, to allow for the required Public Hearing notice, staff review and memo preparation. It is the planner's task to review your application with respect to its compliance with the Code and to write a review memo. In the memo, the planner will recommend approval, denial or tabling of the application and recommend appropriate conditions to this action. The memo is normally available at the end of the week before your hearing. You will be called to pick up a copy of the memo when it is ready, or we can mail it to you if you so request. .. During the period of staff review, it is essential that public notice be given, when required for your development application. Attachment 5 explains how to go about giving the required notice. Your project will be presented to the HPC at a regularly scheduled meeting. A copy of the agenda showing where during the meeting your application is scheduled can be obtained when you pick up the staff memo. The typical meeting includes a presentation by staff, a presentation by you or your representative, questions and comments by the review body and the public and an action on the staff recommendation, unless additional information is requested by the review body. If an application for significant development is being consolidated with the designation process, the conceptual approval must be granted prior to the designation recommendation being made. Significant development is a two step process: conceptual review followed by final review. Conceptual development review is a public hearing, final is not. Usually final review may be accomplished within one month of conceptual approval, depending upon the scope of the project. Once a recommendation is made by the HPC, a review by the Commission can be scheduled. This review is typically scheduled for the next available agenda, within 30 days of the date of the HPC's recommendation. An updated staff memo will be prepared for this meeting, which will again be made available to you just prior to the meeting. Commission action normally requires a single meeting, unless additional information is requested. Once a recommendation is made by the Commission, a review by the Council can be scheduled. This review is typically scheduled for the next agenda, within about 15 days of the date Of the Commission's recommendation. Ordinance adoption, however, requires two readings by Council. The second reading is a public hearing. Due to notice requirements, the second reading is generally scheduled 3 or 4 weeks after first reading. If applicable, the designation grant will be included in the Ordinance. Stage Five: Receipt of Building Permit. Once you have received final approval of your development application, you may proceed to building permit review. During this time, your project will be examined for its compliance with the Uniform Building Code. It Will also be checked for compliance with applicable provisions of the Land Use Regulations which were not reviewed in detail during the one step review (this might include a check of floor area ratios, setbacks, parking, open space and the like). Fees for water, sewer, parks and employee housing will be .. collected if due. Any document required to be recorded, such as a plat, deed restriction or agreement, will need to be reviewed and recorded before a Building Permit is issued. For more information on the Building Permit Stage, please visit the Building Department to obtain handouts on their review procedures. 3. Durant St., Unit #1 - Sandra Lore HISTORIC EVALUATION RATING: Both structures are rated "4" PREVIOUS COMMISSION ACTION: Both structures have received HPC and P&Z recommendations for designation approval; HPC - May 10, 1989, P&Z - June 6, 1989. HISTORIC LANDMARK DESIGNATION STANDARDS: The Standards for Landmark Designation are found in Section 7-702(A) of the Land Use Code. Any structure or site that meets one (1) or more of the standards may be designated as a Historic Landmark. Staff finds that both applications meet the criteria in Standards E. (Neighborhood Character) and F. (Community Character). Standard E. Neighborhood Character. The structure or site is a significant component of an historically significant neighborhood and the preservation of the structure or site is important for the maintenance of that neighborhood character. Response: 514 N. 3rd St.: Clearly, the "Hallam Lake district" has long been considered as one of Aspen's most significant historic neighborhoods. This structure is located within the context of this neighborhood. Its preservation in a critical element in the continued integrity of the historic West End. .. t 1004 E. Durant: The Durant Avenue historic context has been lost overtime. The lone survivor of a once extremely built-out street, 1004 E. Durant would now be considered a significant component of an historically significant neighborhood. Dozens of one and two-story cottages lined Durant 100 years ago; it is amazing to find this cottage, now with its condominiumized addition and in such good condition, still surviving. Its preservation is extremely necessary due to this fact alone. Certainly the historic character of the neighborhood is gone; however, in the larger context of the East Aspen Townsite, 1004 E. Durant is an excellent example of Aspen's family lifestyle heritage. Standard F. Community Character. The structure or site is critical to the preservation of the character of the Aspen community because of its relationship in terms of size, location and architectural similarity to other structures or sites of historical or architectural importance. Response: 514 N. 3rd St.: The Inventory file in the Planning Office states: "The significance of this residential structure is not of those who owned it or lived in it, nor of its architecture, although this structure is representative of Aspen's early mining era. This modest structure is of historical importance by illustrating the family/home environment and life styles of the average citizen in Aspen which was dominated by the silver mining industry." Photos indicate that from 1980 to today, the structure has been altered by an enclosed front porch and the addition of a wing. The original integrity of the simple 12/12 pitch cross gabled roof, projecting front gable bay, chimneys, clapboard and gable peak shingles exists. This structure embodies the small scale miner's cottage style that is indicative in Aspen and speaks to our heritage. 1004 E. Durant: The classic components of an Aspen miner's cottage are the mainstay of this structure. The front porch, the cross gable roof form and pitch, fenestration, materials and chimney are all elements critical to preserve. ZONING: R-6, Landmark Designation is scheduled for final reading before council on July 10. RATING: "4" DESIGNATION NOTES: Landmark Designation is required due to the parking constraints for the two new attic bedrooms created. Ordinance 16, Sec. 2, Paragraph 2, provides for the HPC to waive on-site parking requirements for landmarks if the parcel is unable to contain the number of spaces required. PROJECT SUMMARY: The applicable Guidelines are found in Section VI. Residential Buildings - Renovation and Restoration, beginning on page 47. The Development Review Standards are found in Section 7-601 of the Land Use Code, and are reviewed below, with staff's comments following: 1. Standard: The proposed development is compatible in character with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in an H, Historic Overlay District or is adjacent to a Historic Landmark... Response: This miner's cottage has received a significant addition (south wing) since it was originally inventoried in 1980. The original porch has been enclosed and a duplicate "enclosed porch" added in the new addition. A significantly altered detached carriage house is located at the alley as well. The primary 3rd street (west) elevation is receiving the most significant changes, including two small gable roof dormers and a round window in the primary gable face. In .. our review of other structures in the West End, we find the dormers are not inappropriate on this structure, and are necessary to provide light, ventilation, egress and headroom to the proposed attic bedrooms. (While similar dormers would be considered inappropriate on carriage houses, we find that the dormers proposed do not alter the overall character of the primary structure.) We are not as comfortable with the application of a round gable face window on this primary facade. The applicant has stated this window is necessary for light into the attic bedrooms; we recommend that the original gable shingles remain wholly in tact and that this gable end not receive a window. Another window, oval in shape, is proposed in the north elevation gable end, an alternative shape for this west elevation window. The elaborate Smith-Elisha House, (Queen Anne) contains two large round gable end windows, which is an appropriate application on that facade. Round gable end windows of this nature are generally not found in vernacular cottages. We do find, however, that the round window's size is scaled appropriately, should the HPC approve the alteration. The north, south and east elevations are the least visible, screened considerably by mature trees. The changes proposed on these elevations (deck railing, small gable peak oval window, tri-window with multi-panes and 3 flat roof skylights), are cosmetic in nature, and do not impact the historic character of the structure, in our opinion. The skylight application meets the criteria in the Guidelines. (Please refer to attached drawings.) 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. Response: Staff finds the application meets this standard. Numerous structures in this immediately West End neighborhood have received alterations similar in nature. 3. Standard. The proposed development enhances or does not detract from the cultural value of the designated historic structures located on the parcel proposed for development or adjacent parcels. Response: We find that the cultural value of this structure is in its small scale, which is not being altered with this proposal. 4. Standard: The proposed development enhances or does not diminish or detract from the architectural integrity of a designated historic structure or part thereof. 2 .. Response: Please refer to staff's comments to Standard #1 regarding the dormers. We find that the multi-pane windows proposed for the dormers are small and scaled appropriately; the even placement of the dormers on either side of the front gable face does not diminish the structure's architectural integrity, in our opinion. We would like the applicant to consider the elimination of the round gable peak window on the primary west elevation gable peak, as we find the original architectural integrity Of the cut shingles to be appropriate and should be retained. The other elevation changes proposed are not easily visible, and do not diminish the architectural integrity of the structure, in our opinion. PARKING: Two new attic bedrooms are being created, requiring one on-site parking space each, provided space is available on site (please refer to site plan attached). Ordinance 16 provides the HPC the flexibility to waive this requirement on designated landmarks if adequate surface space is not available on the parcel, provided the applicant has made every effort to provide adequate parking on site. The applicant has met with the Zoning Officer to discuss the site constraints. RECOMMENDATION: The Planning Office recommends that the HPC grant Minor Development approval for the application for 514 N. 3rd St., waiving the parking requirements as allowed in Ordinance 16, Series of 1989.
