You will please note that the total amount is $383.09. In addition, in accordance with my calculations and the recitation on the Condominium Plat, the property as proposed for subdivision into the Jacobie Condominiums contains 0.17S acres which, under the provisions of the Subdivision Ordinance, would mean that the Jacobies would be obligated in the amount of $6.12. for final plat processing. We would ask that you deduct the aggregate of the two sums above recited from the dedication fee paid and remit the same. Please forward the check to me, and I will transmit it to the Jacobies. I would advise you that on December Sth that the plat was executed by Suzette Ann Jacobie, and the SUbdivision Agreement tendered with fees paid. As aconse- quence, it is up to Karen now to. circulate the document for the City's signatures. As I explained to her, the only item which will be missing by way of signature on the Condominium Map will be the statement of Stewart Title Guaranty Company that the ease- ments are free and clear of all liens and encumbrances. As you are aware, those are to be dedicated to the City for the purposes intended. I h~ve in my possession releases of, the deeds of trust. encumbering those easements, which will be tendered for release of record at such time as the Plat is recorded. Owner and subdivider, for herself, her heirs in interest, grantees and assigns, covenants and agrees to and with the City that she will affirmatively consent to and join in the formation of any special improvement district, encompassing all or any part of the subdivision, that may J;i, hereafter be proposed or formed for the construction of any improvement required by the City's subdivision ordinance as now in force and effect respecting street improvements (including paving, curb and gutter, and sidewalk), drainage improvements, and buried electrical improvements. Dear Mick: Pursuant to the request of Mr. Lenny Oates, I have personally examined the subject property, have gathered and analyzed applicable market data for the purpose of estimating the Fair Market Value of the subject site as if vacant, under the Sub- division Dedication Fee requirement, The subj ect site contains 7,500 'square feet and is improved with a two-story frame building containing five, two-bedroom apart- ments. The property is zoned residential-multi family and may be developed as follows: seven studio units, six one-bedroom units, three two-bedroom units, and two three-bedroom units. Although the subject is currently over-improved, it was devel_ oped prior to the current zoning. This analysis concerns only the land value if free and clear under current zoning. My investigation of the most recent sales of residential_multi family properties indicates a range of from $10-12 per square foot. This further reflects values on a per unit basis in the area of $21,000 to $25,000 per two-bedroom unit. The subject site contains interior lots in a slightly less de- sirable, crowded area which would fall near the lower range of value, Therefore: $10 per square foot x 7,500 square feet equals, say $75,000 ($25,000 per unit). The subdivision involves an existing building consisting of five dwell ing units. The matter was considered by the Rlanning and Zoning Commission on August 17th and recommended for approval subject to the resolution of certain boundary descriptions and utility easement locations. These have been reviewed by the City Engineer and resolved to his satisfaction. Dave Ellis does wish to condition approval of the Final Plat on correction of two minor details as follows: 1. Reference to "Parks and Recreation"in the Parks Department approval should be changed to "Parks." 2. Under the Recording Certificate, a notation should be added for the recording information on the subdivision agreement. The subdivision agreement must be finally reviewed as well. P,O, Box 3707 Aspen, Co, 81611 Re: Common Boundary Between 165 Park Circle Condominiums and Jacobie Condominiums Dear Jeff and Lennie: I have decided to address the common boundary line problem On a joint basis since it appears ,that both parties will be involved in the solution, My situation is simply that I cannot simultaneously approve two subdivisions with a common boundary when the surveys do not agree. From the work done in this office it appears neither parcel description by it- self closes mathematically but that the perimeter of the combine~ parcels does close adequately, Thus, the problem again is a matter of deCiding where the common boundary lies. As you know, in the meanwhile, the City Council has more or less adopted administrative delay with regard to the processing, first of duplex conversions and, second, of mUlti-family conversions, pending obtaining data from Brian Goodheim, the Pitkin County Housing Director. We supplied substantial data to City Council ,that hopefUlly helped them to resolve the duplex condominium conversion issue. As you are aware from the materials we sent to you for this meeting, we have also assembled some data and tried to provide some input to City Council with regard to multi-family condominium conversions. We understand that Brian's memo and the matter of multi-family condominium conversions are on your agenda as a study item this evening. We do not wish to take your time by making oral presentations. We have presented written data and are hopeful that you will have considered it. alternatives: All we request is the following, some of which are 1. That you recommend to the City Council that they impose a specific time limit upon Brian to complete the data that he feels necessary, namely the survey of all of the condominiums in town, etc. in order to make his report. While with regard to the duplexes and some of the multi-family matters we spent con- siderable lawyer time, and money on consultants, we are not in the position now to continue that work as AEM and the Jacobie applications involve local people with very little funds rather than developers. Hence, they can't hire further consultants to assist Brian and the City in the study as we otherwise would offer. Thank you once again for your consideration of our problems. The Jacobies and the AEMpartners whom we represent are local people, who we believe will be meeting local needs by condominiumization. With regard to AEM, they went through complete Ordinance 19 review when they originally built the bUilding, and as I have repeatedly stated to all concerned, it surely would be unfair to process and to impose considerable administrative delays upon them and the Jacobies when at the time they applied, the City's policy was clearly to grant subdivision exemptions for such conversions. . ,...... ,......
